Terms of Service

These Terms govern access to and use of Testimoniacs, a platform for collecting, managing and publishing customer testimonials and NPS feedback.
1. Acceptance and minimum age
By creating an account or using the service, you accept these Terms and the Privacy Policy. You must be legally able to contract. Public forms must not be used by children without the legally required involvement of a parent or legal representative.
2. Service description
Testimoniacs provides tools to create collection spaces, receive text and video testimonials, run NPS surveys, organize content, publish approved materials and manage subscriptions. It does not guarantee the accuracy, legality or business results of user-submitted content and is not a legal, marketing or compliance consultancy.
3. Account and security
Provide accurate information, keep credentials confidential and notify us of unauthorized access. You are responsible for activity under your account, content submitted through it and maintaining appropriate permissions for your team. We may require email confirmation and security verification.
4. Plans, prices, renewal and refunds
Paid plans, prices and currency must be displayed at checkout as [PREENCHER PREÇOS E MOEDA]. Unless stated otherwise, subscriptions renew automatically for the same period until canceled. Stripe processes billing and payment data. For distance purchases by consumers, the right of withdrawal under Article 49 of the Brazilian Consumer Protection Code applies within 7 days, subject to legal exceptions. Any additional refund rule must be displayed before purchase.
5. Permitted and prohibited use
Do not use the service for unlawful, fraudulent, abusive or discriminatory activity; to violate privacy or intellectual property; upload malicious code; scrape or reverse engineer the platform; overload or bypass limits; impersonate others; send spam; or collect sensitive or children's data without a lawful basis and required safeguards.
6. Intellectual property
The service, brand, code, layout, documentation and original materials belong to the controller or its licensors. We grant a limited, non-exclusive, revocable right to use the service during an active account. You retain rights in your content and grant the controller a license necessary to host, process, display and operate the service.
7. User content
You are responsible for content you submit and represent that you have the rights and permissions needed for publication. We may remove content that is illegal, infringing, harmful, misleading or contrary to these Terms, and may preserve evidence when legally required.
8. Availability and maintenance
The service is provided without a promise of 100% uptime. Planned maintenance, third-party outages, security events and force majeure may interrupt access. Any applicable service level is [PREENCHER SLA] and does not limit mandatory consumer rights.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect damages, lost profits or losses caused by content or services controlled by third parties. For business users, aggregate liability is limited to amounts paid in the previous 12 months. Nothing excludes liability that cannot legally be excluded, including mandatory rights under the Consumer Protection Code.
10. Suspension and termination
We may suspend or terminate access for non-payment, security risk, unlawful conduct, material breach or legal requirement, with notice when reasonably possible. You may request account closure and export available data before the scheduled purge. Deletion and retention remain subject to the Privacy Policy and legal obligations.
11. Changes to these Terms
We may update these Terms to reflect service or legal changes. Material changes will be communicated in advance through the platform or another suitable channel. If you do not accept them, you may stop using the service and request termination, subject to outstanding obligations.
12. Applicable law and forum
These Terms are governed by Brazilian law, including the LGPD, the Internet Civil Framework and the Consumer Protection Code. Consumer disputes may be brought before the consumer's legally competent forum under Article 101 of the Consumer Protection Code.
